For centuries, notarial acts have been recognised and accepted throughout the world. Notaries are primarily concerned with the authentication and certification of signatures, authority and capacity relating to documents for use abroad. Often a document will have been prepared by a foreign lawyer. They include powers of attorney, sworn statements, contracts, property papers and certificates of law. Notaries must therefore verify for each client their identity, legal capacity and understanding of the document as well as their authority if signing on behalf of another party such as a limited company.
Guernsey notaries are appointed by the Court of Faculties of the Archbishop of Canterbury and are subject to regulation by the Master of the Faculties. All notaries in Guernsey must also be qualified advocates and must undertake further exams to qualify. A notary must also comply with additional stringent practice rules.
