Bio

Dylan Mannikum joined Appleby in October 2018 as a law graduate and after being called to the Bar of Mauritius in January 2022, he joined Appleby’s Mauritius Corporate and Dispute Resolution Departments as an Associate in February 2022.

Dylan appears as junior counsel in commercial litigation matters before the Supreme Court and has also appeared before the lower courts and the Assessment Review Committee. He advises clients on litigation and dispute resolution matters relating to commercial, employment and trust disputes.

He also handles due diligence exercises, the drafting and reviewing of various legal documentation and assists in the preparation of legal opinions.

Dylan is fluent in both English and French.

Work Highlights

Corporate:

  • Assisted in creating a secured security package for Oversea-Chinese Banking Corporation Ltd to support a secured refinancing facility of USD 470,726,777 to Singapore listed company, Ezion Holdings Limited (Ezion). The refinancing, which comprised a total of six lenders, was aimed at enabling Ezion restructure its debt activities. Two Mauritian companies which formed part of the same group of companies as Ezion provided the security package in support of the facility extended to Ezion. Their services are focused on owning, chartering and the management of rigs and vessels within the oil and gas industries and is understood to own one of the largest and most sophisticated fleet of lifeboats worldwide.
  • Assisted in a structured deal of USD 325 million 5.375 % secured notes due 2024 issued by Mauritius-based India Green Energy Holdings demonstrating investor appetite for sustainable investments. India Green used the proceeds from the USD notes to subscribe to seven-year non-convertible debentures to be issued by 11 restricted subsidiaries which are either wholly-owned or majority-owned subsidiaries of ReNew Power Private Limited.
  • Advised Freshfields Bruckhaus Deringer on the regulatory requirements in relation to the Information and Communication Technologies Act 2001 and the local regulatory importation of radio equipment in Mauritius.

 

Dispute Resolution:

  •  Dylan appeared for Canada Life International Limited to initiate a claim, which was based on the interpretation of the effective date of calculation of the Net Asset Value for the redemption of shares and obtained judgment in the sum of USD 752, 854.17 against Metatron as well as USD 100,000 in costs.
  • As from March 2022, Dylan appears for Partner in Performance Global Solutions, a global mining consultancy company, in a breach of contract claim worth above USD 10 million before the Commercial Division of the Supreme Court pertaining to a consultancy services agreement. During the course of the trial, three ruling was delivered by the Judge in favour of Partner in Performance Global Solutions.
  • Represented and advised BB ERP in relation to employments disputes and has obtained three interim injunctions against former employees of BB ERP preventing them from using confidential information and trade secrets in breach of a competition clause under their employment contracts.
  • Represented the MTC Sports and Leisure Ltd, the then sole horse racing organiser, in Plaint with Summons, Injunctions and Judicial Review court actions.
  • Appeared before the Assessment Review Committee in relation to gaming tax assessment raised by the Mauritius Revenue Authority.
Qualifications & Education

Dylan graduated from the University of Central Lancashire with a First Class LLB (Honours) in 2018.

He completed his Bar Professional Training Course at City, University of London and was called to the Bar of England and Wales at the Honourable Society of Middle Temple in November 2020.
